The Holistic Alternative Recovery Trust (HART) issued the following statement after The Justice Department and FDA announced that federal agents seized about 73,000 units of 7-OH products from three Missouri warehouses operated by two companies.
“The seizure of 7-OH products announced yesterday is an unprecedented and dangerous action by unelected bureaucrats,” said Jeff Smith, national policy director of HART. “They are treating an unscheduled product as if it were a controlled substance, without rulemaking, without scientific justification, and without due process. The FDA has not produced clinical evidence that 7-OH presents opioid-class risks, nor has it completed any safety review that would allow the agency to ban these products.
“If an agency can unilaterally declare a product illegal and seize it without transparent rulemaking or statutory authority, then no consumer product category is safe from ad-hoc enforcement.
“One million people have consumed over one billion servings of 7-OH products because those consumers have chosen 7-OH as the safest, most effective way to manage chronic pain and other health challenges. On their behalf, HART calls on the media and Congress to use their oversight authority to scrutinize this extraordinary break from established norms.
“Today’s action raises serious constitutional and administrative concerns that extend far beyond 7-OH. We will continue to press for a clear and evidence-driven regulatory framework, both federally and in the states.”
